• Customer support and training resources.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

3. User Accounts

3.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and notify us immediately of any unauthorized access.

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Tribotic is not liable for any loss or damage arising from your failure to comply with these obligations.

4. Subscription Plans and Payments

4.1 Subscription Plans

Tribotic offers various subscription plans. By subscribing, you agree to:

• Pay all applicable fees as outlined in your selected plan.
• Authorize Tribotic to charge your payment method on a recurring basis (e.g., monthly or annually).

4.2 No Refunds

All payments are final, and no refunds will be issued for any reason, including but not limited to:

• Partial use of the Platform.
• Dissatisfaction with the services.
• Cancellation of your subscription.

4.3 Price Changes

Tribotic reserves the right to modify subscription fees. We will provide at least 30 days' notice before any price changes take effect.

5. GPT Service/Provider

Tribotic utilizes third-party GPT (Generative Pre-trained Transformer) models to power its AI services. The specific GPT provider and model used may vary depending on current market rates, availability, and performance. As of the effective date of these Terms, Tribotic may use models from the following major providers:

• OpenAI (e.g., GPT-4, GPT-4 Turbo)
• Anthropic (e.g., Claude 2, Claude 3)
• Google (e.g., Gemini, Bard)
• Other major providers as deemed appropriate by Tribotic.

Tribotic reserves the right to switch between these providers and models at any time without prior notice.

6. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Violate any laws, regulations, or third-party rights.
• Attempt to gain unauthorized access to the Platform or its systems.
• Upload or transmit viruses, malware, or any other harmful content.
• Use the Platform to harass, abuse, or harm others.

7. Intellectual Property

7.1 Ownership

All content, features, and functionality on the Platform, including but not limited to software, text, graphics, logos, and trademarks, are the property of Tribotic or its licensors and are protected by intellectual property laws.

7.2 License

Tribotic grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your internal business purposes. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Third-Party Services

The Platform may integrate with or link to third-party services. Tribotic is not responsible for the content, privacy policies, or practices of these third parties. Use of third-party services is at your own risk.

9. Data Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using the Platform, you consent to the practices described in the Privacy Policy.

10. Termination

Tribotic may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Non-payment of fees.
• Engaging in fraudulent or harmful activities.

Upon termination, your right to use the Platform will immediately cease.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Tribotic does not guarantee that:

• The Platform will be error-free or uninterrupted.
• The results obtained from using the Platform will be accurate or reliable.
• The Platform will meet your specific requirements.

12. Limitation of Liability

To the fullest extent permitted by law, Tribotic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data.
• Business interruption.
• Costs of substitute goods or services.

In no event shall Tribotic's total liability exceed the amount paid by you for the services in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Tribotic, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses arising out of:

• Your use of the Platform.
• Your violation of these Terms.
• Your infringement of any third-party rights.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Delaware.

15. Customer Responsibility for AI Agent Training and Output

Tribotic provides the tools and infrastructure for creating and customizing AI agents. However, you are solely responsible for:

• Training your AI agents using appropriate data and methodologies.
• Monitoring and reviewing the output of your AI agents.
• Ensuring that the AI agents' responses and actions comply with applicable laws, regulations, and ethical standards.

Tribotic is not responsible for any harm, damage, or liability arising from the use or misuse of AI agents created on the Platform.

16. Changes to These Terms

Tribotic reserves the right to update or modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform or sending you an email. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
